Product Liability
Today
with the laws governing product liability the need for a person to prove a
product or good was faulty is no longer required. The laws ahve changed and now
you can make a claim even if the product was not purchased by you.
How the courts decide if a product liability claim is valid is by determining
how the product was marketed. Was the product marketed in good faith and
according to the manufacturing and sale of goods laws? If so, they may not find
the vendor at fault.
The courts will verify that proper
warnings and correct instructions for use were attached to the product in order
to verify if the vendor was selling the product with the correct cautions
according to the laws.
What Makes a Product
Liability Injury
Claimable?
You must use the product for what is
was supplied to do, unauthorized use of a product for use other than what it is
intended is not a violation of the sale of goods laws. Time is also a factor as
the product needs to be used by its "good to use before date/" If the product
was used after the stamped date then the product may not be at fault.
These laws apply to products,
pharmaceutical medicines and over the counter drugs which you can purchase at a
licensed retail shop. Using medical devices purchase through drugstores and mail
order can also be covered under these consumer protection laws. If you feel you
were injured by a defective product, you should contact a licensed product
liability solicitor or lawyer for advice.
Be sure to find an approved and licensed product liability solicitor or
product liability lawyer and ask for references before selecting the solicitor
or lawyer that will present your personal injury case.
