Slip and Fall
Who is responsible if I get hurt in a public place?
The owner is responsible for running or maintaining a
public place like an office, store or shop. If you get hurt falling due to a
slippery or icy pavement outside a shop the shop owner is responsible to make
the area safe for you to walk on.
Public liability insurance covers you in this case that the shop owner must
provide in order to open a shop for business. When referring to a tort, this is
a slip and fall law that holds the property owner liable for the condition of
their shop. If someone is injured due to slippery surfaces, uneven flooring or
objects in the way of the path they are liable for your safe passage.
What Makes a Slip and Fall
Injury Claimable?
When discussing your claim with your
personal injury solicitor, you will need to tell him what you felt caused the
hazardous situation that related to your having the injury. The solicitor will
work to determine if the shop owner was aware of the danger to you and did not
warn visitors to the shop of the problem or if the shop owner was not aware of
the danger. That is the basis of the negligence of the claim.
As a child may not be aware of the
dangers of a slippery floor, they may be exempt from knowing about this type of
danger since they are not as aware of circumstances. Shop owners must provide
for safety for children too.
Slip and Fall Settlements
At work you would be covered by a
workers compensation insurance plan if you slip or fall and have a personal
injury claim. If you feel you are entitled to a slip and fall settlement due to
you were the victim of a slip or fall personal injury
you will need to contact a slip and fall solicitor or a slip and fall lawyer for legal
advice.
